Discussão sobre as propostas de identidade de género no “Queridas manhãs”: a crónica

Como se sabe, existem duas propostas (BE e PAN) dirigidas a retirar a obrigatoriedade da existência de um relatório médico nos processos de transexualidade. Existirá uma terceira proposta (PS) que ainda se encontra no segredo dos deuses.

Sobre estas propostas, ambas as existentes (e não existem razões para se acreditar que na outra seja diferente) referem na alínea c) do nº1 do Artº 4º que uma pessoa não pode estar interdita ou inabilitada por anomalia psíquica. Questiono qual a definição de “interdita”, de “inabilitada” e “anomalia psíquica”. Por experiência própria sei que a minha definição de determinados verbos e substantivos não é necessariamente concordante com a de outra pessoa.

Mas isto a propósito de ter assistido ontem, Quarta-feira 18 de Janeiro na SIC, no programa “Queridas Manhãs”, a um “debate” de uns 20 minutos sobre as propostas de lei que referi atrás. E digo debate porque, como convidados estiveram o Dr. Décio, como sempre a fazer de testa de ferro para os psis, e David Duarte, homem trans declaradamente pela patologização das identidades trans a fazer o papel do Troll do costume, papel esse muito do agrado do Dr Décio, que anda sempre com um ou outro exemplar para mostrar o que são os “verdadeiros transexuais” segundo a sua lógica.

E aqui veio a primeira curiosidade: neste debate não usou o termo “verdadeiros transexuais” uma única vez. Ou foi a primeira vez que o fez, ou houve uma ou outra que não estou a ver agora, mas é certo que é raríssimo.

Ou seja, convida-se para um debate só um lado e ignora-se o outro. Como abertura do debate, parece-me um pouco tendenciosa. Mas são escolhas de quem faz o programa, escolhas feitas por quem tem legitimidade para as fazer e por quem tem uma agenda e quer manipular a opinião pública.

Começa com o David a, inevitavelmente, descrever como era infeliz antes e como é feliz agora, a lenga lenga usual tão do agrado dos media, não por não ser verdade, mas por ser uma fórmula já demasiado gasta, em que se aproveita para relacionar as cirurgias com o bem estar futuro, subliminarmente negando assim a existência de pessoas transexuais que não desejam a totalidade ou parte das cirurgias, algo que já Harry Benjamin no seu tempo reconhecia e que a WPATH reconhece de há muito, ao contrário da maioria dos psis nacionais e da opinião do Dr Décio, pelo menos até recentemente.

Quando se chega à parte da diferenciação entre homossexualidade e transexualidade, lá veio a esperada pérola do Dr Décio “a homossexualidade é uma orientação sexual e a transexualidade é uma doença”, porque a discrepância entre o cérebro que nos diz que somos de um género e o corpo do outro dá sofrimento, portanto se dá sofrimento é uma doença. Como tal, o amor, por exemplo, que já me deu sofrimento mais do que as doenças que tive, também deve ser uma doença. A discriminação que as pessoas sofrem por serem diferentes, seja porque razão for (ser-se trans, homo, gorda, feia) e que já tem levado a tantos suicídios tem sido abordada pelo lado errado (sociológico). por este ponto de vista é uma doença e deve ser tratada por um médico. Pois é, não faz sentido, não é?

Quando questionado sobre a cessação da obrigatoriedade da apresentação de um relatório médico para se proceder à alteração de nome e género na documentação oficial (e mesmo no acesso a cirurgias e tratamentos hormonais), foi a posição que se esperava: referiu como sempre faz o Dr Harry Benjamin e a WPATH, afirmando falsamente que os psiquiatras e psicólogos seguem as recomendações desta última, não mencionando que (e aqui foi onde se sentiu a falta dos “verdadeiros” e “falsos”) a WPATH nas suas orientações assume todas as identidades trans, desde genderfluid até queer, por exemplo, considerando que são todas válidas e que estas pessoas devem ter o direito de aceder a tratamentos e cirurgias que desejem, coisa que mais à frente o Dr Décio contradiz, e assume a existência de pessoas transexuais que não desejam a totalidade ou parte das cirurgias, coisa que até há bem pouco tempo o Dr Décio era frontalmente contra, pois quem não queria as cirurgias todas não era (verdadeiro) transexual. E esta é a posição, por enquanto dominante, dos psis que controlam os processos de transexualidade. E esta é uma das razões pelas quais os relatórios devem ser excluídos.

Outros critérios abusivos foram aflorados pelo Dr quando afirma dois anos, mais ou menos, para se chegar a um diagnóstico. Casos houve, e pena que a Daniela não tenha apontado isto (já lá iremos) em que, por exemplo, um trans masculino teve o seu processo encravado durante 5 anos por, pasme-se, usar uma trança finíssima no cabelo (muito em moda há uns tempos atrás por alguma juventude) ou como uma trans feminina que andou 7 anos em consultas por usar roupa que o psiquiatra achava que não era muito feminina e por não dar a impressão de querer fazer a cirurgia final (em desrespeito às recomendações da WPATH). Portanto os processos andam, não de acordo com a identidade de género de cada pessoa, mas de acordo com os estereótipos femininos ou masculinos que cada analisador tem.

Portanto os psiquiatras e psicólogos, em vez de exercerem a sua função de ajudar cada pessoa a ser como é e a aceitar-se, exercem o papel de juízes, controladores da moral pública e garante da não existência de aberrações como mulheres com pénis ou homens com vagina, num completo desrespeito das normas da WPATH, tão badaladas pelo representante dos mesmos (leia-se Décio).

Continuando, ambos (David e Décio) concordam com a redução da idade válida para que as alterações possam ser pedidas dos 18 para os 16 anos, o Dr Décio com algumas reticências, não especificadas na altura.

O David tocou então num ponto muito importante: o peso da sociedade, da família e amigos na decisão de nos assumirmos. E este ponto é muito importante. Quantas pessoas vão atrasando o seu coming out por estas razões? Como se sabe, muita gente arrisca-se a perder a custódia de filhos, perder empregos, amizades, vida social, riscos estes inúmeras vezes negligenciados pelos psiquiatras avaliadores (eu própria tive conversas arrepiantes com psiquiatras em que a posição deles era “se é transexual, tem que se assumir, perder empregos, amizades e/ou família não interessa, não temos nada a ver com isso”. Ou seja, um lavar de mãos que arrepiaria Pilatos.

A seguir David meteu os pés pelas mãos ao comentar o fim do relatório médico. Convenhamos, em primeiro lugar, quem quiser acompanhamento psiquiátrico durante o processo tem-no garantido, como qualquer outra pessoa no SNS. O não ser necessário um relatório para se alterar o nome ou aceder a cirurgias que cada pessoa considere premente para o seu bem estar continuará a estar garantido na lei. Segundo, o fim destes processos não implica que uma pessoa se automedique sem acompanhamento médico. Qualquer pessoa pode ir a um endocrinologista e ter acompanhamento médico durante a sua transição. Não tem é um julgamento. O David parece estar convencido que o fim dos processos implica uma proibição dos mesmo. Nada disso, quem quiser que lá vá. Mas por livre vontade, não forçadamente. É disso que se trata.

Vem uns momentos depois mais uma pérola do Dr.. Estilo “estão a ver?” solta a bomba que com esta lei “dez milhões e meio de portugueses podem ir amanhã mudar de nome e tudo se retiram o relatório”. Pois, está-se mesmo a ver. Acrescentando que deixa de ser uma lei de disforia de género para passar a ser um lei geral. Não vejo problema aqui. Mas a seguir deixou um sério aviso às grávidas.

Vejamos a lógica: como deixa de ser necessário um relatório médico, deixa de ser um doença. Como deixa de ser uma doença, deixa de haver médicos para tratarem não-doenças, pois os médicos só tratam doenças. Simples. Portanto, ou a gravidez passa a ser considerada uma doença, ou as grávidas deixam de ser acompanhadas durante a gravidez. Não é? Graças por não ser candidato a bastonário da OM, senão ai das grávidas.

De realçar que, nas propostas encontram-se inscritos o direito a cirurgias e tratamentos que a pessoa deseje, na proposta do BE no nº 2 do Artº 12º, na proposta do PAN no nº 3 do Artº 11º. Logo, uma recusa médica como o Dr Décio diz seria uma desobediência à lei.

E termina a chamar de estúpidos quem apoia a despatologização dos processos, subtilmente afirmando, quando David foi mencionado por João Paulo Rodrigues como “quem passou por este processo e considera o mesmo importante” que “este é inteligente, sabe do que fala”, como se a quantidade de pessoas trans apoiantes da despatologização não o fosse. Normal numa pessoa egocêntrica que pensa: “eu é que sei, eu é que tenho razão, quem concorda comigo é que sabe do que fala, quem tem outra opinião é estúpido e não sabe do que fala, porque se soubessem, concordavam comigo”.

E aqui o Dr esteve francamente mal. Desde há muito que tenho opinião contrária à dele, já o critiquei inúmeras vezes, cada vez que fala sobre estes temas, mais precisamente, mas nunca o ofendi pessoalmente por não concordar comigo, como ele fez, meio dissimuladamente. É um excelente profissional na sua área, cirurgia estética, mas não tem intervenção nos processos, pois só se vai para a cirurgia depois de se ter o processo completo. Como pessoa sempre o achei uma boa pessoa, uma espécie de avôzinho e não estava à espera que entrasse pela ofensa pessoal. Perdeu créditos com essa.

A seguir vem a intervenção telefónica de Daniela Bento, que inicia o seu depoimento com propaganda à ILGA-Portugal qb., fala sobre o processo dela, traz para a discussão o não binarismo o que, num país que ainda não sabe o que são pessoas trans, trazer para debates temas como o não binarismo ou a fluidez de género parece-me um pouco a mais, ainda por cima num programa que não dá tempo sequer para se falar convenientemente sobre o tema escolhido. Mas foi a escolha dela, que deu azo a que o Dr desse o troco questionando onde fez o diagnóstico para mudar de nome e que não se sentir homem nem mulher era um contrassenso em relação ao diagnóstico de disforia de género.

Cláudio Ramos, numa demonstração de ignorância, questionou-a porque mudou de nome (para feminino) se continua fisicamente um homem (boa pergunta mas não nestes termos, se não se sente nem homem nem mulher e prefere ser tratada de forma neutra, porque mudou para um nome feminino?). Daniela embrulha-se, não responde (uma oportunidade perdida para dar voz às pessoas transexuais que não se querem operar), não rebateu nenhuma das afirmações que o Dr fez ao longo do programa (podia tê-lo feito) e entra numa conversa sobre as experiências pessoais identitárias que não eram o assunto em foco. Boa conversa para se ter entre pessoas minimamente dentro do assunto, mas não para se ter num programa destes, em que convém ser-se claro, simples e sucinto. Está-se a falar para uma audiência que à partida nada sabe sobre o assunto.

Seguidamente entra numa retórica entre o público e o privado, que não percebi porque veio à baila, falou da falta de médicos e passou por cima dos problemas com as cirurgias em Coimbra (já que decidiu seguir por esse caminho) existentes. Resultou como manobra de diversão para fugir a questões mais incómodas num programa de tempo limitado, mas não convém ser usado muitas vezes.

No fim, como era de se esperar, vieram os conselhos para ir aos médicos, as ameaças de não doença-não tratamento, a treta do costume e foi a vez do David de fazer propaganda à Jano qb.

Foram feitas no ano passado, no Serviço Nacional de Saúde, quase tantas operações de reatribuição sexual como entre 2012 e 2015. Intervenções acontecem no Porto e em Coimbra.

Conselho Nacional de Ética chumba proposta do BE sobre mudança de sexo
BE quer separar águas e eliminar a exigência de diagnóstico médico para alterar o sexo e o nome nos documentos. PAN apresentou um projecto semelhante e o Governo prepara outro. “Será o menor capaz de decidir?”, questionam os conselheiros sobre a diminuição da idade legal para mudar o registo civil.

Soube-se, por uma notícia do Público (notícia em cima), que o Conselho Nacional de Ética para as Ciências da Vida chumbou a proposta do Bloco de Esquerda sobre, e cito, “mudança de sexo”.

Isto visto que os partidos, ou quem neles se ocupa destes assuntos, insistem em não partilhar informação com as associações/grupos trans, não as mantendo assim a par do que vai sucedendo (ou pelo menos não partilham com algumas delas),

O Conselho Nacional de Ética para as Ciências da Vida (CNECV) é um órgão consultivo independente, que tem por missão analisar os problemas éticos suscitados pelos progressos científicos nos domínios da biologia, da medicina ou da saúde em geral e das ciências da vida. Criado em 1990, funciona junto da Assembleia da República desde 2009.

O chumbo não é nada de admirar, era algo que já se esperava. Mas analisemos a argumentação apresentada para o chumbo.

“O estabelecimento de uma liberdade absoluta do registo de género de cada pessoa tornaria impossível um reconhecimento público da identidade”, alega, acrescentando “Sem pôr em causa o direito que cada pessoa tem a ser aquilo que é, o que inclui, naturalmente, a livre manifestação da sua identidade e expressão de género, não se afigura aceitável, à luz das leges artis médicas, que o exercício de tal direito possa resultar de uma mera manifestação de vontade da pessoa”.

Não vejo como a liberdade de registo de género impossibilitaria um reconhecimento público da identidade. Como é costume nestes casos, deitam a bomba “isto assim faz assim” sem a argumentação associada. “A liberdade absoluta no registo torna impossível o reconhecimento público da identidade”. Como? Não se sabe. Torna e pronto. Faz lembrar aquelas respostas que certos pais dão às crianças quando elas questionam os porquês: “porque sim”.

Pelo contrário, essa liberdade torna, isso sim, possível o reconhecimento da identidade de género pessoal de cada ser humano, sem ter que preencher estereótipos e/ou preconceitos que avaliadores usualmente têm.

Segue-se uma lista de alguns países que já eliminaram a obrigatoriedade de diagnóstico, com a curiosidade de uma gritante falta: a Argentina, o primeiro país do mundo a fazê-lo. De seguida mencionam os países que “vão mais longe”, casos de países que aceitam a existência de um género neutro ou que aceitam a existência de um terceiro sexo.

E depois vem finalmente uma das razões reais do chumbo. Apesar de, como dizem, a WPATH (World Professional Association for Transgender Health) referir que “apenas algumas pessoas com variabilidade de género (leia-se transgénero ou trans) experimentam disforia de género” o conselho entende que não há “fundamentação bastante para prescindir da disforia de género”, logo, do diagnóstico.

Ou seja, o que o conselho não quer é que a sociedade aceite/reconheça as pessoas com variabilidade de género, pois só as que experimentam disforia de género é que poderão aceder a um diagnóstico, logo só essas é que poderão ver o seu género reconhecido. As outras, ou seja, a maioria, não devem ser reconhecidas, segundo o Conselho, e apesar do reconhecimento expresso pela WPATH (que reconhece como uma referência mundial na matéria). Uma posição que deverá lembrar os mais interessados nestas matérias como muito do agrado do Dr Décio: referir sempre a WPATH, mas só seguir o que nos interessa. Ou, em outras palavras, a WPATH pode ser uma referência mundial na matéria, mas nós é que sabemos, nós é que somos os detentores da verdade.

Trocando por miúdos, não querem que existam mulheres com pénis e/ou homens com vagina. Simples. Daí existirem muitos psiquiatras/psicólogos que condicionam o diagnóstico na vontade de se fazer a cirurgia de correcção de sexo. Se queres, tens o diagnóstico; se não queres não o obténs. O facto de se ter uma determinada identidade de género não interessa para nada.

Referem também a paranóia de metamorfose sexual e Koro como doenças que se podem confundir com a transexualidade/transgenderismo, nos quais a autodeterminação está diminuída. E como dizem, “Quem distingue uns de outros?”

Grandes palavrões que ficam sempre bem quando inquiridos por repórteres (ou numa apreciação, por exemplo, mostra-se sempre que se sabe do que se fala) mas que para o cidadão comum não passam disso: pomposos palavrões. Convém portanto explanar-se o que é a paranóia de metamorfose sexual e Koro, para que se entenda do que se fala e porque estes exemplos são falaciosos..

A paranóia de metamorfose sexual pode ser caracterizada como a convicção delirante de se ter mudado de sexo. Este delírio pode ter contornos místicos, sobrenaturais e bizarros, e ser acompanhado por alucinações cenestésicas (alucinações corporais na região genital). Pode manifestar-se em doentes psicóticos.

Koro é uma síndrome de desordem delirante em que um indivíduo tem a convicção avassaladora de que a sua genitália está a diminuir e vai acabar por desaparecer, apesar da falta de evidências nos genitais. Koro também é conhecido como pénis encolhedor. Nas mulheres manifesta-se na vulva e mamilos.

Como se vê, imagina-se a enorme dificuldade de diagnóstico destas duas doenças quando comparadas com a transexualidade. A confusão entre uma pessoa (homem) que entra numa consulta a dizer “sinto-me mulher: sou mulher” pode facilmente ser confundida com “acordei com vagina: Deus transformou-me em mulher” ou com “o meu pipi está a diminuir”. Daí serem precisos psiquiatras que digam que essa pessoa não é transexual, pois o comum dos mortais nunca lá chegaria, ou é isso que querem que transpareça. E quem sabe se erradamente.

E digo erradamente porque estes dois exemplos (a paranóia e o Koro) podem estar a ser vistos/estudados de um ponto de vista errado. A classe médica tem uma tendência para ajuizar tudo de acordo com as suas próprias convicções. Tudo que saia fora do que é considerado normal tem de ser doença, só pode.

Assim, eu questiono: e se os exemplos, em vez de serem factores que excluem à partida um diagnóstico de transexualidade, forem em vez disso sintomas de uma vontade avassaladora de se ser do género de que se realmente é? Parece complicado mas não o é.

Muitos factores existem que contrariam quem nós sabemos que somos. Uma sociedade que não nos vê como quem dizemos que somos, uma noção de normalidade que nos é imposta por essa sociedade, que nos força a ver-nos como freaks, até mesmo uma dificuldade em exprimirmos quem somos por palavras (muitas pessoas trans, em vez de dizerem que são de um determinado género, que é como se sentem e sabem que são, expressam esse sentimento de um ponto de vista social quando dizem que “querem ser mulheres”. Porque apesar de parecer similar, o querer ser qualquer coisa implica que se não é essa mesma coisa. E muita gente, apesar de se sentir de um género, diz que quer ser desse género, ou por dificuldades de expressão ou por uma assimilação do conceito de normalidade social.

Portanto, estes dois exemplos dados pela Comissão de Ética são, no mínimo, muito fraquinhos e denotam uma realidade escondida por trás: uma certa transfobia aliada a um grau indeterminado de desconhecimento.

Prosseguindo, a Comissão julga ainda que separar o procedimento legal do médico, abrir a possibilidade de avançar para a alteração do registo sem um diagnóstico pode levar a “frustração e falsas expectativas.” “É que os médicos estão “vinculados a normas e protocolos de intervenção reconhecidos pela comunidade científica internacional””.

Alterar-se a documentação sem relatório pode levar a frustração e falsas expectativas. Mais uma bomba. Frustração como? Falsas expectativas? Exemplos não há, explicação do que querem dizer, népias. Ou seja, porquê? Porque sim.

E depois vem (e aqui não sei se foi mesmo assim dito, se foi o modo como a jornalista escreveu): É que. Ora para mim, “é que” é como se fosse “porque”. Portanto, fica algo como isto: frustração e falsas expectativas sem relatório porque os médicos estão “vinculados a normas e protocolos de intervenção reconhecidos pela comunidade científica internacional”.

Para falar das normas e protocolos internacionais basta dizer que a WPATH recomenda o acesso de qualquer pessoa da dita variabilidade de género a cirurgias e tratamentos hormonais que desejem, mas cá no nosso burgo só tem acesso quem tem diagnóstico. Ora só tem diagnóstico quem tem disforia de género, que é só uma pequena parte da variabilidade. Como vínculo a normas e protocolos internacionais estamos entendidos.

Acrescento os casos de pessoas transexuais que tiveram os seus processos encravados durante vários anos por não preencherem os estereótipos que quem as tratava tinha para o seu género, e ficamos entendidos sobre que tipo de vínculo têm os médicos com normas e protocolos de intervenção reconhecidos pela comunidade científica internacional.

Terminam com a dúvida sobre se será o menor capaz de decidir (em relação não à falta de relatório mas ao diminuir a idade dos 18 para os 16 anos para se fazer a alteração). Realmente essa dúvida pode-se pôr em relação a quase toda e qualquer pessoa em qualquer idade. Aos 16 anos acredito que qualquer pessoa tenha consciência de quem é. Mesmo os defensores da patologização (sim, mesmo na comunidade trans os há) concordam que aos 16 já se sabe. Portanto aqui é uma mera questão de opinião. Há pessoas com 16 anos mais adultas e capazes de tomar decisões do que outras com 18 ou mesmo com 21. E não é de um dia para o outro que, como que por artes mágicas, uma pessoa se torna capaz. Um dia antes de se fazer 18 anos é-se incapaz e um dia depois já se é capaz’ Isto faz algum sentido? Para mim não. E para quem ler isto se calhar também não.

Finalmente, a classe médica ao terminar os estudos, é obrigada a fazer o juramento de Hipócrates. Essa mesma comunidade não se coíbe de fazer greves e de cobrar pela ajuda prestada a quem deles necessita. E depois falam de ética’??? Ética? Deviam era fazer o juramento Hipócrita. Isto independentemente de como qualquer trabalhador, terem direito á greve. É que ao fazerem o juramento abdicam desse direito. Ou então são uma cambada de mentirosos a jurarem em falso.
