Este ano de 2016 faz 10 anos do bárbaro assassinato de Gisberta Salce Júnior. Para quem esteja agora a iniciar-se nestes temas e para que alguns intervenientes e alguns factos não caiam no esquecimento ou sejam apagados por intenções obscuras, convém fazer-se um pequeno historial.

Gisberta, uma imigrante brasileira, transexual, seropositiva, toxicodependente, prostituta e sem-abrigo, foi encontrada morta a 22 de Fevereiro no fundo de um fosso submerso com dez metros de profundidade, num edifício inacabado na cidade do Porto, a segunda cidade portuguesa. O crime foi confessado por um conjunto de 14 rapazes, entre os dez e os 16 anos, a maior parte deles provenientes de uma instituição de acolhimento de menores financiada pelo sistema de protecção de menores estatal mas ligada à Igreja Católica.

A partir desta confissão, pormenores do terrível acto têm vindo a ser conhecidos. A vítima mortal encontrava-se num estado de saúde profundamente debilitado, e era frequentemente perseguida pelos rapazes, vitima de insultos e agressões. A 19 de Fevereiro, um grupo destes rapazes penetrou no edifício inacabado e abandonado onde Gisberta pernoitava, amarrou-a, amordaçou-a e agrediu-a com extrema violência, a pontapé, com paus e pedras. O grupo confessou igualmente ter introduzido paus no anús de Gisberta, que apresentava grandes escoriações nessa zona do corpo, e tê-la abandonado no local. O corpo apresentava igualmente marcas de queimadura com cigarros.

A 20 e 21 de Fevereiro, voltaram ao local e repetiram as agressões. Na madrugada de 21 para 22 de Fevereiro, julgando-a morta, tentaram frustadamente queimar o seu corpo, numa provável tentativa de ocultação de provas. Não o conseguindo, atiraram finalmente o corpo de Gisberta para o fosso, na altura com água das chuvas. O facto de o corpo não se encontrar a flutuar, mas sim submerso no fundo do poço foi indicativo que esta faleceu por afogamento nesse momento. Com efeito, Gisberta ainda estava viva quando foi lançada ao fosso. Pediu mesmo ajuda aos seus agressores que ignoraram esses pedidos.

A 25 de Fevereiro, publicava no meu blog: “Assassínio
Desta vez em nossa casa, aqui no pacato Portugal, de onde líamos muitas e variadas notícias sobre casos similares, mas sempre "lá fora". Pois bem, o "état de grace" acabou. Tal como com as torres gémeas nos EUA, também aqui se acabou com o mito que estas coisas só acontecem aos outros. Desta feita, tocou-nos a nós. Gi, uma transexual brasileira que habitava no Porto e que foi das pioneiras dos espectáculos de travesti, foi violentamente assassinada, com requintes de malvadez, por um grupo de adolescentes. Pedradas, murros e sabe-se lá que mais. A partir de agora, já não basta lutar contra a homofobia, a transfobia fez a sua entrada.
Que a Gi descanse em paz.”



O seu cadáver foi descoberto um dia depois, após um dos jovens ter contado os factos a uma professora, que avisou as autoridades. O cadáver foi recolhido já ao princípio da noite.

Como reza o comunicado conjunto ªt (Associação para o Estudo e Defesa do Direito à Identidade de Género) e Panteras Rosa, ainda em Fevereiro, em que era pedida uma (re)acção internacional “O caso foi amplamente divulgado pelos media portugueses nos dias 23 e 24 de Fevereiro, de forma errónea e tendenciosa. Enquanto parte da comunicação social nacional falava do assassinato de "um travesti", boa parte destes referiu apenas a condição de "sem-abrigo" ou de "sem-abrigo, prostituta, toxicodependente" de Gisberta, referida também por parte da imprensa como Gisberto, o seu nome legal. Em consonância com esta omissão, desde logo, antes mesmo de serem conhecidos quaisquer pormenores sobre o crime ou sobre a própria identidade e características pessoais da vítima, inúmeros jornais deram eco a artigos de comentadores conhecidos pela sua oposição aos direitos LGBT em Portugal, sustentando que o caso não podia ser classificado como um "crime de ódio" e que não seria legítimo considerar qualquer possível relação com a transexualidade de Gisberta entre as motivações para o assassinato. A argumentação utilizada nesse sentido foi invariavelmente a idade menor da maioria dos confessos agressores.”

Ao mesmo tempo foram sendo ignorados pelos media os comunicados emitidos pelas associações LGBT portuguesas, nomeadamente os posicionamentos das Panteras Rosa e da associação trans (ªt), esclarecendo a "transexualidade" e identidade da vítima e exigindo medidas legais e sociais de combate às discriminações e de protecção contra os crimes de ódio em função de identidade de género, orientação sexual, condição social, doença ou origem nacional, embora tenha sido superficialmente noticiada uma vigília de solidariedade com Gisberta apoiada pelas associações LGBT que teve lugar na noite de 24 de Fevereiro, mas, mais uma vez, os media omitiram a argumentação das associações no sentido de não se ocultar a transexualidade da vítima nem que a discriminação transfóbica pudesse estar entre as prováveis motivações para o crime.

Do governo da altura, a única reacção nos primeiros momentos veio do ministro responsável pelas instituições de menores que se limitou a declarar-se "chocado", sem mais palavras ou comentários, e a instaurar um inquérito à instituição que acolhia os agressores.

Nenhuma fotografia da vítima foi publicada na maioria dos jornais. Os media e os comentadores concentraram o "choque" pelo crime na idade dos agressores, e não no resultado da morte de uma cidadã. Deram eco a insinuações do padre responsável pela instituição de menores, que chegou a afirmar publicamente que um rapaz da instituição estaria a ser "molestado" por um pedófilo, o que seria uma "circunstância atenuante". Estas declarações não levaram à publicação de qualquer reacção pública de indignação. Ao contrário da prática corrente, os dados revelados dia 24 sobre as sevícias sexuais sofridas pela vítima, bem como a possibilidade de esta se encontrar viva quando foi atirada ao fosso, apenas foram publicados por um jornal do Porto. Quatro dias após ter sido denunciado o crime, o silêncio dos media sobre ele era quase absoluto.

Quase imediatamente iniciou-se um aceso debate nas redes sociais sobre o caso. Havia quem o considerasse como homofobia e outros como transfobia. A ILGA Portugal, como não podia deixar de ser, insistia na homofobia, enquanto que a ªt e as Panteras Rosa afirmavam que era um crime transfóbico. A pouco e pouco, e perante os factos que a conta gotas se iam descobrindo, a tese da transfobia ia ganhando terreno e adeptos, até que as afirmações do mais velho dos menores, que “odiava homens com mamas” acabou definitivamente com a tese da homofobia.

A 2 de Março as Panteras Rosa lançavam mais um comunicado referente à autopsia: “Estranhamos profundamente o teor de uma notícia presente no Jornal Público de ontem, segundo a qual "A causa da morte de Gisberta, a transexual espancada, a semana passada, no centro do cidade do Porto, continua por determinar. A autópsia, efectuada no Instituto de Medicina Legal do Porto, não foi conclusiva , não se sabendo assim o que causou exactamente a morte da vítima: se a agressão violenta, se as suas fragilidades de saúde ou mesmo se se tratou de afogamento. (...)"
A 9 de Março foi feita uma vigília frente ao Patriarcado de Lisboa no Campo de Santa Clara pelas 19h.

No dia 10 de Março, Tânia Laranjo, jornalista do Público, noticiava que “Duas semanas depois do corpo de Gisberta, a transexual alegadamente agredida até à morte por um grupo de jovens, ter sido encontrado num fundo de um poço, no Campo 24 de Agosto, no centro do Porto, o Instituto de Medicina Legal reuniu todos os elementos que permitiram identificar a causa da morte da vítima: Gisberta morreu afogada, embora o seu cadáver apresentasse lesões múltiplas que possivelmente também lhe teriam causado a morte em poucas horas. (...) Também segundo o que o PÚBLICO apurou, a transexual apresentava uma série de lesões que terão sido provocadas por espancamento. A autópsia confirmou igualmente as sevícias sexuais, que terão sido provocadas com um pau.”. Este tratamento, referindo Gisberta com a dignidade que merecia, veio-se a revelar não a regra mas a excepção, como se pode confirmar pelo artigo do Correio da Manhã de 5 de Maio que se referia a ela nestes termos: “O único rapaz preso preventivamente pelo caso do assassínio do transexual e sem-abrigo, em Fevereiro último, foi já libertado pelo Tribunal de Instrução Criminal (TIC) do Porto, face às dúvidas da Polícia Judiciária quanto ao seu envolvimento na morte de Gisberta, um brasileiro de 46 anos toxicómano e seropositivo. (...) Gilberto Salce Júnior, conhecido por Gisberta, era um transexual e sem-abrigo, que pernoitava num parque de estacionamento do Porto, tendo sido alegadamente morto à pancada, embora a autópsia tivesse apurado que a causa determinante foi o afogamento. Quando os 14 menores foram ouvidos pela PJ afirmaram que quando foi atirada ao poço a vítima já se encontrava morta. A autópsia revelou, porém, o contrário.”

Com o passar do tempo, os menores que tinham torturado Gisberta durante 3 dias foram lentamente passando de agressores a vítimas: por serem menores, por serem pobres, por estarem institucionalizados, por serem desfavorecidos, como que numa antevisão de uma sentença desculpabilizadora e vergonhosamente branda perante a gravidade dos actos praticados. Quase se chegou a dar a entender que Gisberta é que era culpada: principalmente de ser trans, mas também de ser sem abrigo, toxicodependente e doente.

A Transgender Europe, no seguimento do apelo feito pelas Panteras Rosa e a ªt marcou para 8 de Junho um dia de acção mundial contra o encobrimento deste crime de ódio.



Nesse mesmo dia, 8 de Junho, Lara Crespo como representante da ªt foi entrevistada pela SIC Notícias de manhã e de tarde foi feita uma manifestação na escadaria da Assembleia da República promovida pela ªt, em que participaram, pela ªt Jo Bernardo, Lara Crespo e Eduarda Santos, que aliás, foram as únicas trans a aparecerem e a darem a cara, e personalidades de outras organizações LGBT como Sérgio Vitorino e João Louçã das Panteras Rosa, António Serzedelo da Opus Gay, Paulo Còrte-Real da ILGA Portugal, entre outros. Das personalidades trans que pululam agora por aí arvoreando-se em grandes defensoras da causa trans, e algumas a afirmarem que foi o caso da Gisberta que as impulsionou para o activismo, nem sinal.



O julgamento iniciou-se a 3 de Julho, com o Ministério Público a entender não ser possível demonstrar que foi o grupo de menores que lhe causou a morte. Poucos dias antes do início do julgamento, uma “fonte judicial” afirmava “São miúdos, aquilo foi uma brincadeira que correu mal.”
Os media ao noticiarem o caso escreveram pérolas como o DESTAK de 3 de Julho que apesar de lhe chamar Gisberta apelidava-a de “travesti”, enquanto que para os jornalistas do Jornal de Notícias, Diário Digital e SIC Online era sempre "O" transexual. Salvou-se o Diário de Notícias num artigo de Fernanda Câncio.

Dia 8 de Julho deu-se a primeira marcha do orgulho do Porto, onde Gisberta foi lembrada com flores, uma vela e a leitura de um poema, no sítio onde foi assassinada e onde pela primeira vez houve uma espécie de bloco trans com elementos da ªt e muitas pessoas trans do Porto que conheceram Gisberta, como a Kati ou a Ruth Bianca.



Ainda em Julho em Marselha, nas UEEH (Universités d’Été Euroméditerranéennes des Homosexualités) foi apresentado o documentário Gisberta-Liberdade da autoria de Jo Bernardo (ªt) e Jo Schedlbauer (TGEU), com a presença de Jo Bernardo, Eduarda Alice Santos, e Lara Crespo e Jo Schedlbauer como apresentadores.



Nos finais de Julho, o Ministério Público (MP) deixou cair a acusação de homicídio na forma tentada, com dolo eventual, no julgamento da morte de Gisberta, sendo que os menores ficaram acusados apenas de ofensas corporais qualificadas.

No início de Agosto saía a sentença. O juiz Carlos Portela qualificou as agressões, provadas em tribunal, como “uma brincadeira de muito mau gosto" feita por jovens "que revelavam desprezo pela vida humana", e condenou-os a penas entre os 11 e os 13 meses de internamento em centros educativos, com a família de Gisberta a considerar a sentença uma “porcaria”. O juiz considerou que não agiram por causa da ‘orientação sexual’ da vítima e que foi a água, não eles, quem a matou. Isto apesar do mais velho deles ter afirmado que “odiava homens com mamas”.

João Paulo, do Portugal Gay, afirmou à agência Lusa que as sentenças constituem «motivo de vergonha para toda a sociedade portuguesa e sobretudo para o sistema judicial português». Sérgio Vitorino, do grupo Panteras Rosa, considerou que «o mais grave neste processo é que o tribunal - e por consequência, o Estado - não reconheceu sequer ter aqui existido um assassinato», acrescentando que «É que nem a dignidade desta pessoa - não importa se era transexual ou não - foi reconhecida».

Dos comunicados escritos e enviados, um por Lara Crespo e Eduarda Alice Santos, subscrito por Stephan Jacob, Jó Bernardo, Panteras Rosa, PortugalGay.PT, ªt., e rede ex aequo e outro da ILGA Portugal, nem sinal nos media.

O escândalo desta sentença, e consequentemente deste julgamento, foi de tal ordem que no Público de 3 de Agosto um editorial da autoria de Amílcar Correia pontuava: “Depois de espancada várias vezes (e se não abandonou o local foi porque se encontrava num estado que a impedia de o fazer), o seu corpo foi atirado para um poço com a profundidade de 15 metros, juntamente com um barrote e certamente com alguma intenção, mas Gisberta terá morrido porque não sabia nadar ou porque, sabendo-o, não o quis fazer, pelo que só se pode concluir que este foi um suicídio. Condene-se, pois, a água ou, melhor, o poço.”

Dez anos depois, a ILGA Portugal continua a patologizar a transexualidade e as restantes identidades trans. Algumas pessoas que agora se pavoneiam como grandes defensoras dos direitos das pessoas trans e que bradam aos céus pela despatologização só há pouco tempo o fazem, algumas tendo mesmo sido porta vozes das posições patologizantes (e mesmo por vezes anti-trans) da ILGA Portugal, através do GRIT, durante bastante tempo.

A ªt acabou, e entretanto outras associações/grupos apareceram, como o Grupo Transexual Portugal e mais recentemente a API.

Continua a faltar uma educação sexual inclusiva, que foque a existência das orientações e identidades LGBT, de forma que a médio/longo prazo se acabasse a pouco e pouco com a homofobia, a transfobia e as discriminações associadas.

As pessoas trans continuam sem o direito à auto determinação das suas identidades.

Foi este caso que impulsionou a visibilidade das pessoas trans de uma escuridão em que se encontravam metidas para a luz do dia. Muito graças a ele temos hoje uma Lei de Alteração de Nome e Sexo e é graças a ele que partidos como o Bloco de Esquerda promovem audições de pessoas trans e apresentam propostas legislativas.

E foi graças à ªt e ás Panteras Rosa e ao barulho feito por estas que o caso teve a dimensão mundial que atingiu. Para que nem Gisberta nem estas colectividades caiam no esquecimento, nem que o seu fulcral contributo seja erosado pela areias do tempo ou por mentes mesquinhas.
