ILGA PORTUGAL E GOVERNO VIOLAM INTERNACIONALMENTE OS PRINCÍPIOS DE DIREITOS HUMANOS

A ILGA Portugal é uma IPSS que, segundo os seus estatutos, tem como objetivo «a integração social da população lésbica, gay, bissexual e transgénero (LGBT)», nomeadamente «através da luta contra a discriminação em função da orientação sexual e da identidade de género». No entanto, esta instituição tem resistido duramente a uma verdadeira inclusão das pessoas trans, de forma a que pudesse de facto contribuir no seu objetivo de lutar contra a discriminação em função da identidade de género.

Apesar de estar presentemente a assinalar o seu 20.º aniversário, a ILGA Portugal evita olhar para a sua própria história e assumir os erros que tem vindo a cometer, nomeadamente sempre que defraudou as expectativas da comunidade trans em Portugal, que demasiadas vezes se tem sentido atraiçoada pelas opções tomadas pela mesma. Na memória de muitas pessoas trans, mantém-se ainda a atitude da ILGA Portugal durante a revisão constitucional de 2004, quando cedeu às pressões externas e “descartou” a reivindicação pela inclusão da identidade de género no Artigo 13.º da Constituição da República Portuguesa (o “Princípio da Igualdade”), optando apenas pela inclusão da orientação sexual. Resultado, em muito, desta atitude, a identidade de género, ao contrário da orientação sexual, continua a não estar inscrita no citado artigo, ao contrario da intenção original do movimento LGBT, situação pela qual a ILGA Portugal nunca se retratou publicamente nem pediu desculpas à comunidade Trans.

Desde essa altura, a ILGA Portugal tem-se pautado nas suas intervenções, e desrespeitando a vontade das pessoas Trans, por insistir em posições patologizantes, continuando ininterruptamente a considerar as pessoas Trans como “doentes mentais”. Num documento recente, a ILGA Portugal refere mesmo que «os diagnósticos clínicos que incidem sobre as pessoas trans não se podem referir à sua identidade (isto é, a quem as pessoas são), mas sim ao sofrimento clinicamente relevante que pode derivar da incongruência entre a identidade e o sexo atribuído ao nascimento». Com declarações deste tipo, a ILGA Portugal não hesita em colocar-se do lado da Associação Americana de Psiquiatria, que fazendo ouvidos moucos à comunidade trans internacional, organizada através da campanha STP - Stop Trans Pathologization, manteve as mesmas categorias de diagnóstico estigmatizantes no seu Manual de Estatística e Diagnóstico de Perturbações Mentais (DSM-5) - limitando-se a mudar-lhes os nomes de “Perturbação de Identidade de Género” para “Disforia de Género”, e de “Travestismo Fetichista” para “Perturbação Travesti”.

A atitude pró-patologizante desta instituição tornou-se mais clara a partir do momento em que a ILGA Portugal optou por ter enquanto porta-voz um psicólogo, que tem demonstrado interesses carreiristas na abordagem aos direitos trans, colocando-se numa posição híbrida entre defensor da classe profissional a que pertence e defensor das pessoas trans, pese embora não estabeleça contato nem ligações com as próprias pessoas e ativistas trans e suas organizações, o que se estranha querendo falar em nome das mesmas.

Do mesmo modo que assinalamos que a ILGA Portugal tem feito ouvidos moucos às vozes trans que se manifestam contra estas posições, nunca tendo feito um mea culpa público, reforçamos que estas posições são inteiramente contrárias aos princípios dos Direitos Humanos, e aos avanços que o ativismo trans tem conseguindo alcançar nos últimos anos. A intervenção da ILGA Portugal, no que concerne à identidade de género, apoia-se unicamente em estudos académicos e teses construídas contra os discursos de pessoas trans, dando mesmo a esses investigadores a oportunidade de serem porta-vozes da instituição ou do movimento em aparições e relatos nos mais variados media.

Mais, todas as posições assumidas pela ILGA Portugal têm sido tomadas sem qualquer esforço ou tentativa de articulação com as vozes trans existentes, recusando-se a ouvi-las, salvo quando quer apropriar-se dos seus discursos, como é o caso da reivindicação pela autodeterminação. O silenciamento da ILGA Portugal sob as pessoas trans, chega ao ponto de desprezar sistematicamente o contributo do GRIT - Grupo de Reflexão e Intervenção sobre Transexualidade, composto por pessoas trans associadas da instituição, relegando a participação dessas pessoas à organização de eventos e debates que não ganham qualquer projeção na intervenção pública da instituição, e limitando a intervenção dos seus membros aos relatos das suas histórias pessoais.

A posição expressa por Nuno Pinto, psicólogo, investigador e membro da direção da ILGA Portugal que, num artigo intitulado “ILGA quer que mudança de identidade deixe de exigir relatório clínico”, afirmou que a instituição que representa pede «uma alteração à lei 7/2011 que vá ao encontro das mudanças no paradigma clínico e que respeite a autodeterminação das pessoas trans, porque elas, melhor do que ninguém, "sabem quem são"» (Lusa/Notícias ao Minuto, 14/03/16), é uma posição antiga da comunidade Trans, que de resto tem encontrado na ILGA Portugal uma grande oposição. Esta posição foi, inclusive, expressa por várias pessoas e ativistas trans, de diferentes coletivos e organizações, na audição parlamentar “Pessoas trans e intersexo: que reconhecimento e que novos direitos?”, acolhida pelo Bloco de Esquerda a 5 de maio de 2015. É estranho, ou então apenas conveniente, que esta posição agora apareça como sendo da ILGA Portugal.

Também estranhamos que Catarina Marcelino, Secretária de Estado para a Cidadania e Igualdade, segundo a mesma fonte, esteja a trabalhar com «as Organizações não-governamentais LGBTI para alterar o regime de identidade de género», quando as organizações representativas das pessoas trans, afinal as mais capacitadas e interessadas, não estão a ser envolvidas, nem foram sequer contatadas para o efeito.

Foi, de facto, das vozes de pessoas trans que partiram reivindicações como a autodeterminação do género, a criação de opções de género não-binárias (além do "F" e do "M") ou o fim da discriminação de menores de idade e estrangeiros no acesso ao reconhecimento jurídico do género. A reivindicação pela autodeterminação baseia-se, de resto, não só numa melhoria ao "regime de identidade de género", mas numa mudança de paradigma que permita às pessoas trans autodeterminarem-se e autorepresentarem-se em todas as esferas da vida, sem interferência de terceiros, incluindo organizações sem legitimidade para falarem sobre nós.

Por estes motivos, os grupos, organizações e pessoas individuais abaixo assinadas consideram que a ILGA Portugal não tem presentemente qualquer espécie de legitimidade para falar em nome da comunidade Trans. As pessoas trans em Portugal têm vozes próprias, e os seus próprios representantes e não aceitarão mais serem meros observadores passivos ou cativos de instituições que à margem das mesmas continuam a roubar espaço público e político deteriorando o princípio mais básico que é o direito à identidade, deixando para terceiros a reivindicação dos seus interesses ou a representação das suas vozes.

Em conclusão, queremos fazer saber aos órgãos políticos, governamentais e de comunicação social, que devem fazer cumprir com as recomendações internacionais (como a Recomendação CM/Rec(2010)5 do Comité de Ministros do Conselho da Europa), assim como as nacionais, e cessarem de uma vez por todas com o insistente descrédito à população trans, que exige falar e representar-se na primeira pessoa.
